5. Bookings, Payments, Rescheduling and Cancellations

Power Potential is committed to delivering high-quality care and efficient appointment availability. To support this, the following booking and cancellation conditions apply.

5.1 Bookings

All appointments, consultations, testing sessions, classes, recovery sessions, and other services are subject to availability.

Bookings may require payment in advance, a deposit, or valid payment details at the time of booking.

Power Potential reserves the right to cancel or refuse a booking where payment is not made within the required timeframe.

5.2 Payments

All fees must be paid in accordance with the terms advised at the time of booking or invoicing.

We may use third party booking and payment systems. By making a booking, you agree to the applicable terms of those providers as well.

5.3 Rescheduling

If you need to reschedule an appointment, we request as much notice as possible.

Unless otherwise stated for a particular service:

  • rescheduling requests made with sufficient notice may be accommodated subject to availability;
  • rescheduling requests made within a short notice period may incur an administrative or late-change fee.
 

5.4 Cancellations

Unless otherwise stated in writing for a specific service, package, event, or agreement:

  • cancellations made with less than 24 hours’ notice may incur the full appointment fee;
  • missed appointments or “no shows” may be charged in full;
  • late arrivals may result in shortened treatment times without reduction in fee;
  • where a practitioner has been specifically allocated for a booking, the full fee may be charged if the appointment cannot reasonably be filled.
 
 

6. Refunds

Refunds are not generally provided for change of mind.

Where permitted, approved, or required by law:

  • refunds may be processed back to the original payment method or as a credit;
  • administration fees may apply where permitted;
  • any refund rights under the Australian Consumer Law are preserved.
 

 

7. Gift Cards, Packages and Prepaid Services

7.1 Permitted Use

Gift cards, prepaid packages, and service credits may only be redeemed for eligible Power Potential services specified at the time of purchase.

These may include selected clinical, recovery, wellness, or testing services, unless otherwise excluded.

7.2 Exclusions

Unless expressly stated otherwise, gift cards, packages, and service credits may not be used for:

  • cash redemption;
  • the purchase of another gift card;
  • expired services;
  • promotional offers where excluded;
  • third party products or retail items; or
  • any service specifically excluded at the time of issue.

7.3 Non-Transferable / Non-Refundable

Gift cards and packages are non-transferable and non-refundable, except as required by Australian Consumer Law.

7.4 Expiry

Gift cards and packages are subject to the expiry date stated at the time of purchase. Unused value or sessions after expiry may be forfeited unless otherwise required by law.

7.5 Availability

Redemption is subject to booking availability. Power Potential does not guarantee availability at any particular time, date, or practitioner.

 

8. Conditions of Entry

Power Potential reserves the right to refuse entry to or remove any person from our facilities where necessary for safety, clinical, operational, or behavioural reasons.

By attending a Power Potential facility, you agree that:

  • you will comply with all staff directions, health and safety instructions, and facility rules;
  • you will complete any required pre-screening, intake forms, waivers, or consent forms before participating in services;
  • you will disclose any relevant medical conditions, injuries, contraindications, or concerns that may affect your safety or suitability for treatment or facility use;
  • you will behave respectfully towards staff, practitioners, and other clients.
 

8.1 Minors

Where services are provided to persons under 18 years of age:

  • a parent or legal guardian may be required to provide consent;
  • minors may be required to attend under adult supervision depending on the service;
  • certain services or facilities may be restricted based on age, safety, or clinical suitability.

MEMBERSHIPS

1. TERMS AND APPLICATION

1.1 Application

Your membership is governed by this Membership Agreement (“Agreement”).

1.3 Acceptance

Submission or acceptance of this Agreement does not automatically guarantee membership. All applications may be subject to review and approval by Power Potential.

1.4 Amendments

Power Potential reserves the right to amend this Agreement at any time. Updated terms will apply upon notice or continued use of membership services.

2. MEMBERSHIP

2.1 Membership Access

Membership provides access to selected services, facilities, and protocols in accordance with your Membership Type, including:

  • Recovery facilities (e.g., sauna, cold immersion, compression)
  • Performance and wellness services
  • Selected clinical or testing services (where applicable)

Access is subject to:

  • Booking availability
  • Operational capacity
  • Any exclusions specified in your Membership Details

Power Potential reserves the right to exclude certain services, locations, or offerings from membership inclusions.

2.2 Changes to Details

You must notify Power Potential immediately of any changes to:

  • Contact details
  • Health status (where relevant)
  • Payment details

2.3 Non-Transferable

Memberships are strictly non-transferable without prior written approval from Power Potential.

3. PAYMENTS

3.1 Membership Fees

Membership fees:

  • Must be paid in advance
  • Are non-refundable (except where required by law)
  • Are payable via the agreed payment method

3.2 Failed Payments

If a payment fails:

  • A dishonour fee may apply
  • Outstanding amounts must be paid immediately

3.3 Late Payments

You are responsible for any additional fees incurred due to:

3.4 Payment Authorisation

By entering this Agreement, you authorise Power Potential (and its payment provider) to debit:

  • Membership fees
  • Late cancellation or no-show fees
  • Dishonour fees
  • Any outstanding balances

3.5 Suspension for Non-Payment

Power Potential may suspend or terminate your membership if payment obligations are not met.

3.6 Fee Changes

Membership fees may be adjusted at any time with 28 days’ notice.

If you do not accept the change, you may terminate your membership prior to the new fee taking effect.

4. ACCESS & FACILITY USE

4.1 Bookings

All services must be booked in advance via the designated booking system.

  • Availability is limited
  • Preferred times are not guaranteed

4.2 Late Cancellation & No-Show

If you:

  • Cancel late, or
  • Fail to attend a booking

The session may:

  • Be deducted from your membership or credits
  • Incur a fee

4.3 Minimum Age

  • Minimum age: 16 years
  • Under 18:
    • Requires parental/guardian consent
    • May require supervision depending on service

4.4 Orientation

Where required, you must complete an orientation session before using facilities or equipment.

Power Potential may suspend access if orientation is not completed satisfactorily.

4.5 Surveillance

For safety and security, facilities may use video surveillance.

By entering the facility, you consent to this.

4.6 Personal Property

Power Potential is not responsible for:

  • Lost
  • Stolen
  • Damaged personal belongings

4.7 Rules & Conduct

You must:

  • Follow all facility rules
  • Comply with staff directions
  • Use equipment safely

Failure to comply may result in suspension or termination.

4.8 Health Responsibility

You acknowledge that:

  • Participation is at your own risk
  • You must not participate if medically unfit
  • You should seek medical advice where appropriate

You confirm that:

  • You do not have any condition that would make participation unsafe
  • You will inform staff of any relevant health concerns

Power Potential does not provide medical advice outside of formal clinical consultations.

5. TERMINATION

5.1 Minimum Term

Memberships may be subject to a minimum term (e.g., 12 payment cycles), as specified in your Membership Details.

5.2 Termination Without Cause

After the minimum term, either party may terminate with written notice in accordance with the cancellation period.

5.3 Termination for Breach

Either party may terminate immediately if:

  • A breach occurs and is not remedied within 7 days
  • The breach is serious or cannot be remedied

5.4 Termination by Power Potential

Power Potential may terminate or suspend membership immediately if:

  • Payments are not made
  • Rules are breached
  • Conduct is unsafe, inappropriate, or disruptive
  • Membership type is discontinued

5.5 Restriction of Access

Power Potential may restrict access at any time where there are concerns regarding:

  • Safety
  • Health
  • Behaviour
  • Compliance

5.6 Effect of Termination

Termination:

  • Ends future obligations
  • Does not affect outstanding payments or accrued rights.
 
 

6. RELEASE & INDEMNITY

6.1 Assumption of Risk

You acknowledge that:

  • Use of facilities and participation in services carry inherent risks
  • You participate voluntarily and at your own risk

6.2 Release of Liability

To the maximum extent permitted by law, you release Power Potential and its:

  • Directors
  • Practitioners
  • Staff
  • Contractors

From any liability arising from:

  • Injury
  • Loss
  • Damage
  • Participation in services

Except where caused by gross negligence or unlawful conduct.

7. GENERAL PROVISIONS

7.1 Assignment

Power Potential may transfer its rights and obligations under this Agreement.

7.2 Severability

If any provision is invalid, the remaining provisions remain enforceable.

7.3 Interpretation

This Agreement is not to be interpreted against a party solely because they prepared it.

8. DEFINITIONS

Facility – Any Power Potential clinic or location
Services – All recovery, clinical, performance, and testing services
Membership – Access rights granted under this Agreement
Membership Fee – The fee payable for membership
Term – Duration of membership
Written Notice – Notice provided via email, in person, or post.

ASSUMPTION OF RISK & WAIVER OF LIABILITY

PLEASE READ CAREFULLY – THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS

This is a legally binding agreement. If you do not understand any part of it, you should seek independent legal advice before signing.

 

A. SERVICES, EQUIPMENT & ENVIRONMENT

  1. You agree to only participate in services and use equipment in accordance with this agreement and staff instructions.
  2. You acknowledge that services may involve exposure to extreme or changing conditions, including but not limited to:
    • Heat (sauna, infrared)
    • Cold exposure (ice baths, cryotherapy)
    • Physical exertion (exercise, VO₂ testing)
    • Changes in oxygen levels or breathing demands
    • Compression, pressure, or restricted movement
    • Wet environments and surfaces
  3. You acknowledge and understand all risks outlined in the Risk Warning above.
  4. You understand that participation may be:
    • Physically demanding
    • Conducted individually or in a group setting
    • Subject to environmental and equipment-related risks
  5. You acknowledge that Power Potential is not responsible for the conduct of other participants.
  6. You voluntarily assume all risks, known or unknown, associated with your participation.
 
 

B. HEALTH, FITNESS & PERSONAL RESPONSIBILITY

  1. You confirm that:
    • You are physically and medically fit to participate
    • You have no condition that would make participation unsafe
  2. You acknowledge that Power Potential:
    • Has not made a full medical assessment of your suitability
    • Does not replace your medical practitioner
  3. You agree to:
    • Seek medical advice prior to participation if unsure
    • Disclose all relevant health information
    • Immediately stop activity if experiencing discomfort, pain, or adverse symptoms
  4. You acknowledge that participation without proper medical clearance is at your own risk.
 
 

C. COMPLIANCE WITH DIRECTIONS

  1. You agree to follow all:
  • Staff instructions
  • Facility rules
  • Safety procedures
  • Signage and protocols

Failure to comply may result in immediate removal from services.

 

D. LIABILITY, RELEASE & INDEMNITY

  1. To the maximum extent permitted by law, you:
 

(a) Release Power Potential Healthcare Group Pty Ltd and its:

  • Directors
  • Practitioners
  • Employees
  • Contractors
  • Agents

From any liability for:

  • Injury
  • Illness
  • Death
  • Loss or damage

arising from your participation in services, use of equipment, or attendance at the facility.

(b) Indemnify Power Potential against any claims, costs, damages, or actions arising from:

  • Your participation
  • Your failure to follow instructions
  • Your failure to disclose medical conditions
  1. You acknowledge that you are giving up your right to bring legal action against Power Potential for any injury, loss, or damage sustained, except where liability cannot be excluded under Australian law.
 
 

E. GENERAL PROVISIONS

  1. You confirm that you are not relying on any representations or statements made by Power Potential beyond those contained in this agreement.
  2. If any part of this agreement is found to be invalid, the remaining provisions will continue in full force.
  3. This agreement is binding on you and your legal representatives, successors, and assigns.

Facility – Any Power Potential clinic or location
Services – All clinical, recovery, testing, and performance services
Equipment – Includes (but not limited to):

  • Sauna, ice baths, compression systems
  • Testing equipment (VO₂, force plates, etc.)
  • Rehabilitation and exercise equipment

Participation – Any use of services, equipment, or attendance at a facility

MINORS & UNDER 18 CONSENT, WAIVER & LIABILITY AGREEMENT

PLEASE READ CAREFULLY – THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS

This is a legally binding document. If you do not understand any part of this agreement, you should seek independent legal advice before signing.

By allowing a minor (“Child”) to participate in any services at Power Potential Healthcare Group Pty Ltd (“Power Potential”), you agree to the following terms.


A. SERVICES, EQUIPMENT & ENVIRONMENT

  1. Your Child may only participate in services and use equipment in accordance with this agreement and all staff directions.
  2. You acknowledge that participation may involve exposure to extreme or changing conditions, including but not limited to:
    • Heat exposure (sauna, infrared therapy)
    • Cold exposure (ice baths, recovery pools)
    • Physical exertion (exercise, performance testing)
    • Changes in oxygen demand or breathing intensity
    • Compression, pressure, or restricted movement
    • Wet environments and surfaces
  3. You and your Child acknowledge that participation carries significant risks, including but not limited to:
    • Musculoskeletal injury (sprains, strains, fractures)
    • Cardiovascular events
    • Dizziness, fainting, dehydration
    • Infection or illness
    • Psychological or physiological stress
    • Permanent disability or death
  4. You acknowledge that services may be delivered:
    • Individually or in group settings
    • In dynamic and controlled environments
  5. You acknowledge that Power Potential is not responsible for the actions of other participants or third parties.
  6. You and your Child voluntarily assume all risks associated with participation.


B. CHILD’S HEALTH, FITNESS & RESPONSIBILITY

  1. You confirm that your Child:
    • Is physically and medically fit to participate
    • Has no condition that would make participation unsafe
  2. You acknowledge that Power Potential:
    • Has not conducted a full medical assessment of your Child
    • Does not replace medical advice from a qualified healthcare provider
  3. You agree to:
    • Seek medical advice prior to participation where appropriate
    • Disclose all relevant health conditions
    • Ensure your Child immediately ceases activity if unwell or experiencing symptoms
  4. You confirm that your Child does not have any contraindicated conditions unless medically cleared.


C. SUPERVISION & COMPLIANCE

  1. You and your Child must comply with all:
  • Staff instructions
  • Facility rules
  • Safety procedures
  • Signage and protocols
  1. A parent or legal guardian (or approved responsible adult) must:
  • Provide consent prior to participation
  • Be contactable at all times
  • Supervise where required by Power Potential
  1. You are responsible for:
  • Your Child’s behaviour
  • Ensuring safe and appropriate use of equipment
  • Compliance with all rules and instructions
  1. Minimum age requirements:
  • 16 years and above permitted to participate
  • Under 18 requires parental/guardian consent
  • Under 16 participation only where expressly approved by Power Potential

D. LIABILITY, RELEASE & INDEMNITY

  1. To the maximum extent permitted by law, you:

(a) Release Power Potential Healthcare Group Pty Ltd and its:

  • Directors
  • Practitioners
  • Staff
  • Contractors

From any liability for:

  • Injury
  • Illness
  • Death
  • Loss or damage

arising from your Child’s participation in services, use of equipment, or attendance at the facility.

(b) Indemnify Power Potential against any claims, costs, damages, or actions arising from:

  • Your Child’s participation
  • Failure to follow instructions
  • Failure to disclose relevant medical conditions
  • Non-compliance with facility rules
  1. You acknowledge that you are waiving your right (and your Child’s right) to bring legal action against Power Potential, except where liability cannot be excluded under Australian law.


E. GENERAL

  1. You confirm that:
  • You are not relying on any representations outside this agreement
  • You fully understand the risks involved
  1. If any part of this agreement is found invalid, all remaining provisions remain enforceable.
  2. This agreement is binding on:
  • You
  • Your Child
  • Your legal representatives and successors

F. DEFINITIONS

Child – A person under 18 years of age under your care
Facility – Any Power Potential clinic or location
Services – All clinical, recovery, performance, and testing services

Participation – Any attendance, use of services, or engagement in activities
